Rob Usry of Holland & Usry Secures Additional $1 Million Settlement for Spartanburg County Teen’s Traumatic Brain Injury Case

Rob Usry of Holland & Usry, a Spartanburg, South Carolina accident injury law firm, recently secured an additional $1 million settlement for a Spartanburg County teenager who sustained a brain injury in a car accident. The settlement is the maximum amount payable from a corporate underinsurance policy owned by the child’s parents.

Before hiring Rob Usry, the child’s parents negotiated a nearly $900,000 settlement from the at-fault driver’s liability coverage. The crash occurred in 2024. The child rode as a passenger in a car driven by the at-fault driver in Greenville. The at-fault driver turned left, failing to yield the right of way to oncoming traffic. An SUV driving 45 miles per hour slammed into the passenger side, directly into the child.

The child suffered a traumatic brain injury with multiple skull fractures and multiple brain hemorrhages, plus fractures to the bones around the left eye. He required emergency brain surgery with partial skull removal to relieve brain pressure. He was in the hospital for nearly two months, including a week in the intensive care unit on a ventilator. After that, he spent two weeks in a brain rehabilitation facility. He required long-term, extensive therapy to regain brain and muscle function, including the ability to walk and talk.

A major obstacle in finalizing the settlement was repaying health insurance through the subrogation process. Holland & Usry staff worked months to unravel an extensive web of billing and insurance providers to successfully settle those accounts.

Rob guided the child’s parents to place the child’s portion of the settlement into a structured settlement. The structured settlement will increase the amount paid to the child over time and provide the child with periodic payments after he reaches adulthood.
